Floored is currently operated by Floored. A company is in the process of being formed, and once it is established it will assume operation of, and full responsibility for, the Floored app, including these Terms.

1. Acceptance

By using Floored you agree to these Terms. If you do not agree, do not use the app.

2. The service

Floored is a dance game: it uses your device camera to score your movement, and lets you record routines, dance routines others have published, and compete on scores.

3. Your account

Your account is tied to an anonymous device identifier, or to Sign in with Apple if you choose it. You are responsible for activity on your account. You can delete your account and published content at any time from inside the app (open the app, tap the ⓘ button, then "Delete account").

4. Your content and your rights

You keep ownership of routines and clips you create. By publishing, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute the pose data and any clip you publish, so the app can function and other users can view and compete with it. You represent and warrant that:

Do not publish content that infringes anyone's rights. We may remove content and terminate repeat infringers, see our Copyright / DMCA Policy.

5. Acceptable use

Don't use Floored to harass, impersonate, post unlawful, infringing, or sexually explicit content, or interfere with the service. You can report or block other users from the menu on any routine; we may remove content and suspend accounts that break these rules.

6. Purchases

Floored is free to play. Optional purchases ("Floored Plus" subscription and a "Party Pass") are sold through Apple and billed to your Apple Account; subscriptions auto-renew until cancelled in your App Store settings. Prices are shown before purchase. Refunds are handled by Apple under their terms.

7. Intellectual property

Floored, its name, and its software are ours or our licensors'. The royalty-free music catalog is licensed to us; do not extract or redistribute it.

8. Disclaimers

The service is provided "as is," without warranties of any kind, to the fullest extent permitted by law. Dancing is physical activity, take care of yourself and your surroundings.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the service.

10. Changes

We may update these Terms; continued use after an update means you accept the change.

11. Governing law

These Terms are governed by the laws of New Zealand, without regard to its conflict-of-laws rules. Nothing here removes mandatory consumer-protection rights you have where you live.
